When you’re dealing with debt, the collection process can sometimes feel overwhelming. But here’s what many people don’t realize: you still have rights, and efforts are underway to strengthen them.

In the Philippines, regulations are in place to protect borrowers from unfair and abusive collection practices, while allowing legitimate lenders to recover what is owed in a lawful and respectful manner. Now, with the recent Senate approval of the Fair Debt Collection Practices Act, there is a move toward clearer, nationwide standards for debt collection.

The country has long enforced protections through the SEC Memorandum Circular No. 18, Series of 2019 (Prohibition on Unfair Debt Collection Practices).

This regulation prohibits abusive, unfair, and deceptive collection behavior by financing and lending companies, including third-party agencies. 

In addition, a major development occurred in March 2026. The Philippine Senate approved the proposed Fair Debt Collection Practices Act (Senate Bill No. 1744) on third and final reading. This bill seeks to regulate debt collection practices and ensure fair treatment for borrowers throughout the collection process.

The push for stronger protections didn’t happen overnight. Recent data shows just how serious the issues have become. The Presidential Anti-Organized Crime Commission (PAOCC) received over 47,000 complaints against abusive online lending apps (OLAs) from 2024 to early 2026, while the National Privacy Commission received 2,244 complaints from 2018 to 2025.

These cases often involved borrowers being harassed or threatened, publicly shamed, or exposed through their personal contacts or social media.

The proposed measure clearly defines prohibited practices:

  • Use threats of violence or harm
  • Send messages with insults, profanity, or abusive language
  • Publicly shame borrowers or expose personal information
  • Contact your employers, coworkers, or unrelated third parties
  • Make repeated or excessive calls/messages at unreasonable times
  • Use deception or pretend to be a legal authority
  • Collect amounts beyond what is agreed in your contract

At its core, the bill recognizes two important realities:

  • Borrowers deserve protection and dignity
  • Lenders have the right to collect legitimate debts

The goal is to strike a balance between respecting consumers’ rights and allowing debt collectors to do their jobs properly and lawfully. It sets boundaries within Philippine law that both borrowers and collectors must respect.

If enacted into law, the Fair Debt Collection Practices Act will help ensure that:

  • You are treated with respect and professionalism during collection
  • Debt collection follows clear and consistent rules
  • Abusive practices are more clearly defined and penalized

Just as important, it reinforces this message:

Having debt does not remove your rights.
